Terms of Service

1. Agreement

These Terms of Service ("Terms") apply to the Aristockrat website and web application (the "Service"). "We", "us" and "our" refer to Aristockrat; "you" refers to the person using the Service. By using the Service or creating an account you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy and Cookie Policy explain how we handle personal data.

2. The Service

Aristockrat collects publicly available market and company data and processes it with automated, rules-based models to produce scores, ratings, indicators and other analysis of listed companies. How the scores are calculated is described on the methodology page.

Part of the Service is free. A paid plan, PRO, unlocks additional features as described on the pricing page at the time you subscribe. We may change, add or remove features to improve the Service. If a change significantly reduces the PRO features you are paying for, you may cancel and we will refund the unused part of the current billing period.

3. No investment advice

Investing in financial markets involves risk, including the possible loss of all the money you invest. Past performance and model results do not guarantee future returns. You are solely responsible for your investment decisions. Consider seeking advice from an authorised professional before making them.

4. Eligibility and accounts

• You must be at least 18 years old and able to enter into a binding contract to use the Service.
• The information you give us when creating an account must be accurate, and you must keep it up to date.
• Your account is personal. Keep your password confidential and do not share your account with others. You are responsible for activity under your account unless it results from our failure to keep the Service secure.
• Tell us promptly through the contact page if you suspect unauthorised use of your account.
• You can delete your account at any time from your account settings.

5. PRO subscription and payment

• Price: the price of PRO is shown before you subscribe and at checkout, including any VAT that applies.
• Billing: PRO is billed monthly in advance. Payments are processed by Stripe. We do not receive or store your full card details.
• Renewal: your subscription renews automatically at the end of each billing period until you cancel.
• Cancellation: you can cancel at any time from your account, through the billing portal. Cancellation takes effect at the end of the current billing period, and you keep PRO access until then. Apart from your right of withdrawal below, and unless the law requires otherwise, payments for a billing period that has already started are not refunded.
• Failed payments: if a renewal payment fails and is not resolved, your account returns to the free plan.
• Price changes: we will tell you about a price change at least 30 days before it applies to your subscription. If you do not agree, you can cancel before the new price takes effect.

6. Right of withdrawal (EU and UK consumers)

If you are a consumer in the European Union or the United Kingdom, you have the right to withdraw from your PRO subscription within 14 days of subscribing, without giving any reason.

To withdraw, send us a clear statement of your decision through the contact page, using the email address of your account, before the 14 days have passed. We will refund the payment within 14 days of receiving your statement, using the same payment method you used, unless you agree otherwise. If you asked for PRO to start during the withdrawal period, we may keep an amount in proportion to the part of the period in which you used it before withdrawing.

7. Acceptable use

You agree to use the Service lawfully and not to:

• copy, scrape or extract data from the Service in bulk, by automated means or otherwise, beyond normal personal use;
• resell, redistribute, publish or commercially exploit the scores, ratings or data without our written permission;
• try to gain unauthorised access to the Service, other accounts, or our systems, or interfere with their security or operation;
• get around usage limits or access restrictions, for example by sharing one PRO account between several people;
• reverse engineer the Service or use it to build a competing product;
• use the Service in a way that breaks applicable law, including market abuse rules.

8. Data and availability

The Service relies on data from third-party sources, which can be delayed, incomplete or wrong, and our models can produce results that turn out to be inaccurate. We work to keep the data correct and up to date, but we do not guarantee that it is accurate, complete or current, or that the Service will be available without interruption or errors. We may suspend the Service temporarily for maintenance, updates or reasons outside our control.

9. Intellectual property

The Service, including its software, design, texts, scores and the methodology behind them, is protected by intellectual property rights that belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable right to use the Service for your own information, in line with these Terms. No other rights are transferred to you. Market data remains the property of its respective providers.

10. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or close your account if you seriously or repeatedly breach these Terms, or if we are required to by law. Where reasonable, we will tell you beforehand and give you a chance to fix the problem. If we close your account without a breach on your part, we will refund any prepaid fees for the remaining part of the billing period.

11. Liability

We are not liable for investment decisions you make or for losses resulting from them, including losses resulting from errors, delays or omissions in the data, scores or analysis.

To the extent permitted by law, our total liability arising from these Terms or the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, and we are not liable for indirect or consequential losses, such as loss of profit or loss of data.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for intent or gross negligence, for death or personal injury caused by negligence, or your statutory rights as a consumer.

12. Responsibility for misuse

If you use the Service in breach of these Terms or the law and a third party brings a claim against us as a result, you are responsible for the losses and reasonable costs this causes us, to the extent permitted by law.

13. Changes to these Terms

We may change these Terms, for example when we change the Service or when the law changes. The date at the top shows the latest version. We will tell account holders about significant changes by email or with a notice in the Service at least 30 days before they take effect. If you do not agree, you can cancel your subscription and delete your account before the changes apply. If you continue to use the Service after that, the new Terms apply.

14. Governing law and disputes

These Terms are governed by the laws of Romania. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of that country. We encourage you to contact us first, so that we can try to resolve any complaint informally.

15. General

• If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in effect.
• If we do not enforce a right under these Terms, that does not mean we waive it.
• You may not transfer your rights under these Terms to anyone else without our consent.
• These Terms, together with the policies they refer to, are the entire agreement between you and us about the Service.
